The Ministry of Justice is proposing amendments to the legislation to strengthen the protection of individuals' image rights. The draft has been submitted for public discussion.

According to the proposed law, amendments are planned to be made to the Civil, Labor and Administrative Codes. In particular, Article 100-1 of the Civil Code may require that the recording and use of a person's image be carried out only with the consent of the person or, in the case of minors, with the consent of their parents.

Use of an image means its disclosure, distribution, storage, processing, or printing.

Situations where filming without consent is possible:

➖to film the general proceedings at weddings or other public events;
➖to record illegal activities;
➖to film civil servants performing their official duties;
➖The image was created by an individual and is available to everyone;
➖When declaring a wanted person in the image in accordance with the procedure established by law;
➖When an image of a person taken for a fee is used for the purpose intended for obtaining this image;
➖To ensure security, individuals may be filmed through video surveillance systems (warning signs must be installed).

Violation of personal privacy may result in administrative liability. If unauthorized filming is carried out using secret technical means, a fine of 3.75 million to 15 million soums may be imposed.

The bill will be debated until March 28. A ban on using a person's images without their permission was also proposed in 2020, but was not implemented.
